These Terms and Conditions ("Terms") constitute a legally binding agreement between you and My Budget Bestie ("we," "us," or "our"), governing your access to and use of the My Budget Bestie application and website at budget-bestie.com (collectively, the "Services").
By creating an account or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Services.

You must be at least 18 years of age to use My Budget Bestie. By using our Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.
If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
We do not knowingly collect information from or market to users under 18. If we learn that a user is under 18, we will immediately deactivate their account and delete all associated data.
My Budget Bestie is a personal budgeting and expense-tracking application. Our Services allow you to:
We reserve the right to modify, suspend, or discontinue any feature of the Services at any time with reasonable notice where possible.

To use the Services, you must register for an account. You agree to:
We are not liable for any loss or damage arising from your failure to comply with these security obligations. We reserve the right to disable any account that we reasonably believe has been compromised or is being used in violation of these Terms.
My Budget Bestie offers a free plan with core budgeting features. Free plan users are subject to usage limits (such as a maximum number of expenses per month). These limits may change over time; we will provide reasonable notice of material changes.
We offer a Premium subscription that unlocks additional features including, but not limited to:
Premium features are available only to active paying subscribers. Features included in Premium may change over time. We will not remove core features without notice.
Premium subscribers may access AI-powered financial insights. These insights are generated using anonymised summaries of your financial data (expense totals, budget amounts, goal progress) sent to Anthropic's API. You can opt out of AI insights at any time in Settings โ Notifications โ AI Insights. When disabled, no data is sent to Anthropic.
All payments are processed securely by Stripe. By subscribing to Premium, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on the plan you select). You are responsible for all applicable taxes.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We will not notify you before each automatic renewal, so please set a reminder if needed.
We reserve the right to change our subscription prices. We will give you at least 30 days' written notice of any price increase via email or in-app notification. Continued use of the Premium plan after the price change takes effect constitutes your acceptance of the new price.
You may cancel your Premium subscription at any time through Settings โ Manage Subscription or by contacting us. Cancellation takes effect at the end of your current billing period โ you will retain access to Premium features until then. We do not pro-rate partial periods.
We offer a 7-day refund on your initial Premium purchase if you are not satisfied. To request a refund, contact us at mybudgetbestie16@gmail.com within 7 days of your first charge. Refunds for renewal charges are considered on a case-by-case basis. We reserve the right to decline refund requests that we believe are made in bad faith.
If a payment fails, we may attempt to re-charge your payment method. If payment cannot be collected, your account may be downgraded to the free plan and you will lose access to Premium features.
You own your data. All financial information you enter into My Budget Bestie (expenses, budgets, goals, notes, etc.) belongs to you. We do not claim any ownership rights over your data.
By using the Services, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your data solely for the purpose of providing the Services to you. This licence ends when you delete your account.
We do not sell your data. We do not share your financial data with third parties except as necessary to provide the Services (e.g., payment processing via Stripe, AI insights via Anthropic when you have opted in).
You are solely responsible for the accuracy and legality of any data you enter. We do not verify or validate any financial data you input.
When you delete your account via Settings โ Delete Account, all your data โ including your profile, expenses, budgets, goals, debts, and folders โ is permanently and immediately deleted from our servers. This action is irreversible.

All content, features, and functionality of the Services โ including but not limited to the app design, interface, logos, graphics, text, and code โ are owned by My Budget Bestie and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial purposes in accordance with these Terms.

The Services may contain links to third-party websites. These links are provided for convenience only and do not constitute endorsement. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MY BUDGET BESTIE AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Liability Cap: In any event, our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the claim. If you have not made any payments (i.e., you are on the free plan), our total liability to you shall not exceed CAD $10.00.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to defend, indemnify, and hold harmless My Budget Bestie and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
Before filing any formal legal claim, you agree to first contact us at mybudgetbestie16@gmail.com and attempt to resolve the dispute informally. We will try to resolve any complaint within 30 days.
If a dispute cannot be resolved informally, you agree that any legal action or proceeding shall be brought exclusively in the courts of Ottawa, Ontario, Canada, and you consent to the personal jurisdiction of such courts.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws in your jurisdiction that cannot be waived by contract.
You may terminate your account at any time by going to Settings โ Delete Account. This will immediately and permanently delete all your data. If you are on a paid plan, you will retain access until the end of your current billing period but will not receive a refund for the remaining period unless eligible under our refund policy.
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behaviour, or if required to do so by law. Where possible, we will give you advance notice and an opportunity to remedy the violation.
If we terminate your account due to a breach of these Terms, you will not be entitled to a refund.
Upon termination, your right to use the Services ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including the sections on Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.
We reserve the right to modify these Terms at any time. When we make material changes, we will:

The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and My Budget Bestie with respect to the Services and supersede all prior agreements, representations, and understandings.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely, including in connection with a merger, acquisition, or sale of assets, upon notice to you.
